of your home country. You should plan on spending about two weeks in the USA after
your child(ren)'s delivery.
Legal Issues for Surrogacy in the USA
In 48 out of 50 states in the USA, paid surrogacy is legal. By law, all children born in the USA are eligible for United States citizenship. The child gets his/her own US passport and is not added to their parent's passport.
After obtaining a Birth Certificate, the Intended Parents may choose to apply for citizenship at their Embassy or at least register their child(ren)'s birth. It will simplify things later to apply for citizenship in your home country. Please contact your embassy for all necessary documents required to register for Birth Abroad.
NOTE: Citizenship laws vary from country to country and are subject to change.
To Summarize:
- The Intended Parents will obtain a birth certificate into their own names.
- Child will obtain a US citizenship by birth and US Passport to travel home.
- The Intended Parents should register the birth of their child in their Embassy in
the USA to facilitate the process of obtaining their home citizenship later.
MARRIED COUPLES: Birth Certificate is issued into the Intended
Parents names directly at the Department of Vital Records. The married couple will
be responsible for having their attorney petition the Family Court at the county
where the birth of the child will occur.
SINGLE FATHERS: Birth Certificate is issued into the Gestational
Carrier's Name and the Biological Father's name, regardless if the donor's egg was
used or not. Another option is to issue a Birth Certificate into the Biological
Father's name only.
CHILD'S NATIONALITY: Passport for the child born in the USA is
obtained in the Embassy of your country. In some cases, due to complications in
citizenship laws, it is more convenient to apply for the USA nationality for the
child born in the USA, since US laws allows it, and later to apply for the father's
nationality at your Embassy or at home. You and your attorney will be responsible
for obtaining all necessary details and documents for this.
Surrogacy FAQ's for Prospective Parents
Indian Egg Donors has compiled a list of frequently asked questions and answers
to better assist prospective parents. If you have any questions that are not addressed
below or need more surrogate information, please contact us and we will do our best
to assist you.
Who works with a surrogate?
Some women are unable to carry a child due to multiple reasons, some of which are: hysterectomy, heart conditions, high blood pressure, and age. Other prospective parents, such as single male/female and same sex male couples, need to work with a surrogate in order to have a genetic link to their child.
Does Indian Egg Donors work with single parents and same sex couples?
Yes. We believe that the right to have children should be available to anyone, regardless of age, sex, religion, marital status, ethnicity, nationality, or sexual orientation.
Who are the surrogates?
Our surrogates are between the ages of 21-40 years old. Every potential surrogate
fills out a detailed questionnaire, which contains extensive information on their
medical history, physical characteristics of themselves and their family, their
motivation to become a surrogate, educational background, and their personal habits
and interests.
All surrogates are screened by an IVF clinic for their ability to conceive via embryo
transfer and to carry a child to term prior to the beginning of the process. Testing
for a surrogate includes: psychological testing (MMPI test), test for ALL sexually
transmitted diseases, and monitoring ultrasounds at the designated IVF clinic throughout
the whole process.
Why are surrogates psychologically evaluated?
The surrogate meets with a psychologist or social worker to discuss her emotional,
social, and family background, as well as her motivations, feelings, and thoughts
about being a surrogate. This process gives the surrogate the chance to raise concerns
she might have and ensures that she is psychologically prepared to move forward.
Why do Prospective Parents need a psychological consultation?
You will discuss your current circumstances and concerns, and explore issues related
specifically to working with a surrogate in order to prepare you for the path ahead.
You may also have joint sessions with your surrogate and her husband/partner to
discuss shared expectations about communication, as well as future roles and relationships.
Do you work with intended parents who want to work with an egg donor, sperm donor,
and surrogate?
Yes.
Do you work with prospective parents who want to work with donor embryos?
Yes.
How long does the surrogacy process take?
The process usually takes between 12-15 months. The time length is largely dependent
on your own schedule and how quickly you want to proceed.
